1. Overview

Leadsburg is committed to full compliance with the Telephone Consumer Protection Act (TCPA) of 1991 and all related Federal Communications Commission (FCC) regulations. This policy outlines our practices regarding telephone communications, text messages, and automated calling systems.

2. What is the TCPA?

The Telephone Consumer Protection Act is a federal law that regulates telemarketing calls, auto-dialed calls, prerecorded calls, text messages, and unsolicited faxes. The law requires businesses to:

  • Obtain prior express written consent before making marketing calls using an automatic telephone dialing system (ATDS) or prerecorded voice
  • Honor do-not-call requests
  • Maintain internal do-not-call lists
  • Identify the caller and provide contact information
  • Restrict calling hours to between 8 AM and 9 PM local time

3. Our Consent Practices

Prior Express Written Consent

Before you receive any marketing calls, text messages, or communications from us or our partners, we obtain your prior express written consent through clear and conspicuous disclosure. This consent includes:

  • A clear statement that you agree to receive calls and/or text messages
  • Identification of the parties who may contact you
  • Disclosure that calls may be made using an automatic telephone dialing system or prerecorded voice
  • Statement that consent is not a condition of purchase
  • Your electronic signature (checkbox, button click, or similar)

Consent Language Example

"By clicking 'Submit,' I provide my express written consent to be contacted by Leadsburg and its marketing partners at the telephone number I provided, including through the use of automated technology and prerecorded messages. I understand that consent is not required to make a purchase. Message and data rates may apply. Message frequency varies."

4. Types of Communications

With your consent, you may receive:

  • Live telephone calls from our representatives or partners
  • Prerecorded voice messages with information about products and services
  • Text messages (SMS/MMS) with offers and updates
  • Automated calls using an automatic telephone dialing system

5. How to Opt-Out

You have the right to revoke your consent at any time. To stop receiving communications:

  • Text Messages: Reply STOP to any text message
  • Phone Calls: Tell the representative you wish to be placed on our do-not-call list
  • Email: Send a request to optout@leadsburg.com
  • Online: Submit a request through our website contact form
  • Mail: Send a written request to our mailing address

We will process your opt-out request within 10 business days. You may receive communications during this processing period.

6. Calling Hours

We and our partners only initiate telephone communications between:

8:00 AM - 9:00 PM (Your Local Time)

Monday through Sunday

7. Message Frequency and Rates

Message frequency varies based on your interactions and requests. Standard message and data rates may apply depending on your mobile carrier and plan. Leadsburg is not responsible for any charges incurred from your carrier.

8. Partner Compliance Requirements

All partners and affiliates receiving leads from Leadsburg must:

  • Comply with all TCPA regulations and FCC rules
  • Honor consumer opt-out requests immediately
  • Maintain their own internal do-not-call lists
  • Use consent data only for authorized purposes
  • Implement appropriate call time restrictions
  • Identify themselves properly on all calls
  • Maintain records of consent for at least 5 years

9. Record Keeping

We maintain detailed records of all consent obtained, including:

  • Date and time consent was provided
  • Method of consent (web form, phone, etc.)
  • Exact language presented to the consumer
  • IP address and device information (for web submissions)
  • Phone number(s) for which consent was given

These records are retained for a minimum of 5 years to demonstrate compliance.

10. Wireless Telephone Numbers

We recognize that many consumers use wireless phones as their primary contact number. We obtain explicit consent before calling or texting wireless numbers and clearly disclose that standard messaging and data rates may apply.
